These Website Terms of Service ("Terms") govern access to and use of the New Mexico Environment Department's ("NMED," "we," "us," or "our") public websites, web pages, web applications, and online services that link to these Terms (collectively, the "Site"). By accessing or using the Site, you agree to be bound by these Terms.
1. Scope and Intended Use
The Site is provided for informational and public‑service purposes, including access to environmental information, program materials, notices, forms, and resources. The Site may include content describing programs, guidance, and access to public records and tools. NMED may add, remove, or modify content, features, or functionality at any time without notice.
2. Acceptance of the Terms
By accessing or using the Site, you agree to comply with these Terms and any changes posted in the future. If you use the Site on behalf of an entity, you represent and warrant you have the authority to bind that entity. If you do not agree to these Terms, do not use the Site.
3. No Legal Advice; No Official Version
Information on the Site is provided as a convenience and may not reflect the most current legal or technical developments. The Site may include summaries, guidance, or references to statutes, regulations, permits, or orders.
Nothing on the Site constitutes legal advice and nothing on the Site should be relied upon as the official version of any law, rule, or official agency record. For matters affecting legal rights or obligations, consult the authoritative official sources and records. 4. Accuracy Disclaimer; No Warranties
The Site and all information, documents, data, and materials on or made available through the Site ("Content") are provided "AS IS" and "AS AVAILABLE."
To the maximum extent permitted by law, NMED disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. NMED does not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

5. Limitation of Liability; Sovereign Immunity
To the maximum extent permitted by law, NMED will not be liable for any damages of any kind arising out of or related to your use of (or inability to use) the Site, including any direct, indirect, incidental, consequential, special, exemplary, or punitive damages.
Nothing in these Terms waives, modifies, or diminishes any governmental immunities or limitations of liability available to NMED, including under the New Mexico Tort Claims Act (NMSA 1978, §§ 41-4-1 et seq.) and other applicable law.
6. Security, Monitoring, and Acceptable Use
Use of the Site may be monitored and recorded for security, operational, and law-enforcement purposes. Unauthorized access or misuse may be subject to civil and criminal penalties.
6.1. Prohibited Activities
You agree not to:
- Attempt to gain unauthorized access to the Site, servers, systems, networks, or accounts connected to the Site;
- Interfere with, disrupt, degrade, or impair the Site or its operation;
- Introduce malware, bots, scraping mechanisms that materially burden systems, or other harmful code;
- Attempt to probe, scan, or test system vulnerabilities without authorization;
- Use the Site to violate any applicable law or regulation.
7. Intellectual Property; Permitted Use
Unless otherwise stated, Content on the Site is owned by, licensed to, or used with permission by NMED and may be protected by copyright, trademark, and other laws.
You may view, download, and print Content for personal, informational, non-commercial purposes unless a page, dataset, or document states different reuse terms. You may not modify, republish, distribute, or create derivative works from Content without permission, except as permitted by law or expressly stated on the Site.
Trademarks. NMED names, seals, logos, and related marks may not be used in a manner that implies endorsement or affiliation without prior written permission.
8. Links to Third-Party Sites
The Site may link to third-party websites or platforms (including social media). NMED does not control and is not responsible for the availability, content, security, or privacy practices of third-party sites. Links are provided for convenience and do not constitute endorsement.
9. User Submissions
Certain Site features may allow you to submit information ("Submissions", e.g., comment portals, webforms, uploads, emails, or other communications).
By providing Submissions, you represent that:
- You have the right to provide the information;
- The Submission is accurate to the best of your knowledge (as applicable);
- The Submission does not violate law or infringe others' rights.
NMED may use Submissions to operate programs, respond to requests, improve services, and for other governmental purposes consistent with applicable law.
10. No Confidentiality.
Do not submit confidential, privileged, or sensitive personal information unless specifically requested through an approved, secure channel.
11. Public Records; IPRA Notice
Communications and materials submitted to NMED—whether through the Site, email, forms, or otherwise—may be subject to disclosure as public records under the New Mexico Inspection of Public Records Act (IPRA) (NMSA 1978, Sections 14-2-1 to -12). 12. Privacy
NMED's handling of information collected through the Site is described in applicable privacy notices posted on the Site Information collected through the Site is handled according to applicable privacy notices and New Mexico law.
13. Accessibility
NMED strives to provide accessible digital services, and this site uses the AudioEye Accessibility-Certified third-party service to provide Accessibility functionality. If you encounter accessibility barriers, please contact NMED using the contact information in Section 18 so we can work to provide access.
14. Emergency or Time-Sensitive Reporting
The Site is not intended for emergency communications. Do not use the Site to report emergencies. If you have an emergency, call 911 or the appropriate emergency number.
15. Changes to These Terms
NMED may update these Terms at any time. The "Last Updated" date indicates when these Terms were last revised. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
16. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
17. Governing Law; Sovereign Immunity; Venue
These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles. Venue for any dispute arising from or relating to the Site or these Terms shall lie in a court of competent jurisdiction in the State of New Mexico, as permitted by law. Nothing waives governmental immunity under the New Mexico Tort Claims Act.
